By accessing or using www.exquisvin.com (the “Site”) and related services including auctions, Fellowship memberships, vineyard leasing, and bespoke bottlings (the “Services”), you agree to be bound by these Terms & Conditions (“Terms”). If you do not agree, you must not use the Site or Services.
The Services are intended only for individuals eighteen (18) years of age or older, in compliance with Singapore laws relating to alcohol. By registering, you warrant that you meet this requirement and that your use of the Site complies with all applicable laws.
Certain Services (including auctions and vineyard leasing) require an active Fellowship account. You are responsible for maintaining the confidentiality of your login credentials. Exquisvin reserves the right to suspend or terminate accounts for breach of these Terms, misuse, or fraud.
Bids placed through the Site are legally binding. The highest valid bid at auction close constitutes a contract of sale. Payments must be made within the stated timeframe. Failure to pay may result in cancellation, suspension of Fellowship membership, and forfeiture of deposits. Exquisvin acts as an intermediary between sellers and buyers unless otherwise stated.
Vineyard leasing and personalised bottling are governed by separate written agreements. Exquisvin does not guarantee harvest yield, quality, or continuity, as these depend on agricultural and natural factors outside our control.
Unless otherwise specified, all prices are in Singapore Dollars (SGD). Payments must be made through authorised payment channels (e.g., Stripe, PayPal, bank transfer). Buyers are responsible for applicable duties, excise, or import taxes.
Delivery terms will be communicated at checkout. Risk transfers to the buyer upon delivery to the agreed address or upon collection. Exquisvin is not liable for customs delays, refusal of entry, or seizure in the destination jurisdiction.
All content on the Site—including text, images, logos, and software—is owned by Exquisvin or its licensors. You may not reproduce, distribute, or exploit such content without prior written consent.
You may not: (a) use the Site for unlawful purposes; (b) misrepresent identity, submit false bids, or engage in fraud; (c) attempt to interfere with Site security; (d) copy, distribute, or reverse-engineer Site code or content.
To the fullest extent permitted by law: Exquisvin shall not be liable for indirect, incidental, or consequential losses (including loss of profit, opportunity, or goodwill). Nothing excludes liability for fraud, wilful misconduct, or obligations under applicable Singapore law.
You agree to indemnify and hold harmless Exquisvin, its directors, officers, and employees against all claims, losses, damages, or costs arising from your breach of these Terms or misuse of the Services.
The Site may contain links to third-party websites. Exquisvin does not endorse or accept responsibility for such sites, and access is at your own risk.
Exquisvin may suspend or terminate your access immediately upon breach of these Terms. Upon termination, your right to use the Site ceases immediately, but accrued obligations (including payment) survive.
These Terms shall be governed by the laws of Singapore. You agree to submit to the exclusive jurisdiction of the Singapore courts for any dispute arising from or related to these Terms.
Exquisvin may amend these Terms at any time by updating this page. Continued use of the Site after amendments constitutes acceptance of the revised Terms.
16.1 Auction Purchases: All successful bids in auctions are final and legally binding. Exquisvin does not accept returns or cancellations once an auction has closed, except as required by law.
16.2 Wine Sales (Non-Auction): For direct retail purchases (outside auctions), orders may be cancelled within 24 hours of confirmation, provided the order has not been dispatched. Once dispatched, sales are final and non-refundable, except as required by law.
16.3 Faulty, Damaged, or Incorrect Goods: If wines are delivered in a faulty, damaged, or incorrect state, you must notify Exquisvin in writing within 48 hours of delivery. Exquisvin may, at its discretion, arrange for replacement, credit, or refund, subject to verification. Due to natural characteristics of wine (e.g., cork taint, bottle variation, ullage), Exquisvin does not guarantee taste or drinkability.
16.4 Vineyard Leasing & Bespoke Bottlings: Vineyard leasing and custom bottling agreements are governed by separate contracts. Refunds or cancellations are only permitted in accordance with those contracts.
16.5 Refund Method: Approved refunds will be processed using the original payment method within thirty (30) business days.
16.6 Exclusions: No refunds or returns will be provided for: (a) change of mind; (b) improper storage by the customer (heat, sunlight, poor cellar conditions); (c) natural ageing effects (sediment, cork movement).
